TERMS & CONDITIONS

SCOPE

These general terms and conditions (GTC) apply to all legal relationships between www.nicolemohrmann.com and Customers ("Customer" or "Purchaser"), who may be deemed either consumers as meant by § 13 BGB ("consumer") or entrepreneurs (merchants) as meant by § 14 German Civil Code (BGB) ("Entrepreneur"). All Customers must be of age.

The Customer expresses its understanding that this GTC applies by clicking on "I accept your Terms and Conditions" and sending the completed order form as part of the order process. Any terms and conditions of the Customer do not apply, unless www.nimowithlove.com has agreed to their validity in writing.

 

FORMATION OF CONTRACT

The Customer’s ordering of a product constitutes a binding offer from the customer. A binding offer is made by virtue of completing and sending the order form provided on our website.


A purchase contract between the purchaser and www.nimowithlove.com comes about only by virtue of a written delivery confirmation from www.nimowithlove.com or the actual delivery of the ordered goods to the purchaser. www.nicolemohrmann.com may reject a purchaser’s offer without providing a reason. The prices quoted on the website are in Euro and include statutory VAT, yet do not include shipping costs.

REFUND POLICY
You may return the goods without providing a reason within 20 days. This does not apply to personalized goods. This period begins after this instruction is received in writing (for example, by letter, e-mail, fax), yet not before the goods are received by the recipient (where if similar goods are delivered on a recurring basis, then not before receipt of the first partial delivery) and not before our other information obligations are fulfilled. You may also effectuate your return by requesting the goods be taken back in writing (return request) only in the case of goods which cannot be shipped by parcel (for example, bulky goods). The timely dispatch of the goods or the timely dispatch of the return request suffices to meet the deadline. In any case, the return shall take place at our expense and risk.

CONSEQUENCES OF A RETURN

If an effective return is made, the services received by both parties must be returned and, if applicable, use must be surrendered. If the goods have deteriorated in condition or with respect to uses (for example, benefits of use that cannot be surrendered or only partially or in a deteriorated condition, you must provide us with appropriate compensation (value replacement). You must only replace the value of the goods for the deterioration of the goods and benefits of use to the extent that the use or the deterioration is due to handling the goods in a manner beyond the mere examination of its properties and mode of operation. The term "examination of its properties and mode of operation" refers to the examination and testing of the respective goods that would be customary and possible and in a retail store. Obligations to make reimburse payments must be fulfilled within 30 days. This period begins for you with the return dispatch of the goods or the return request; for us, this period begins with the receipt of the returned goods.

If the goods are used, worn, washed or damaged, or if the reimbursement label is no longer affixed to the one-time seal, full reimbursement of the replacement value is required.


RETURN DISPATCH
The goods must be returned using the UPS courier service as well as the UPS shipping document provided with the goods. www.nimowithlove.com will pay the shipping costs for goods returned in this manner. Please contact  the UPS courier service to arrange a pick up at the below service numbers:

Make sure to include your exact pick up address. You may schedule a pickup appointment with UPS.
 

www.nimowithlove.com is not responsible for any damage or lost packages if they were not shipped with UPS. Likewise, www.nimowithlove.com will not cover shipping costs if another courier service than UPS is used.

DELIVERY AND SHIPPING

Deliveries to Germany are handled by UPS. All shipments that are sent by www.nimowithlove.com are insured against theft and accidental damage. Upon receipt of shipment and written acknowledgement, this insurance coverage ceases to exist.

Please be aware that we cannot deliver to post office boxes. In case of partial shipments, shipping costs will be charged only once.

We process and send orders during our main service hours, Monday to Friday, from 10:00 am till 5:00 pm CET (with the exception of German public holidays). The merchandise will be ready for dispatch one business day after the receipt of payment, at the latest.

CUSTOMS DUTIES & TAXES

Please note that all deliveries outside the EU may incur customs duties and / or taxes. The maximum limit for duty-free shipments is set by the customs authorities of each country. Further information can be found on the website of your competent customs authority.

TRACK YOUR STATUS

As soon as we have shipped your order you will receive an email stating the UPS tracking number. You can check the status of your order one to two hours after receiving the email via the link provided.

RETENTION OF OWNERSHIP
The delivered goods remain the property of www.nimowithlove.com until full payment is received.


BILLING / RETURN PAYMENT

A party is entitled to a setoff if its counterclaims have been established as legally executable, or the other party recognizes them as undisputed or acknowledges them in writing. Additionally, the party is only entitled to exercise a right of retention to the extent that its counterclaim is based on the same contractual relationship purchase.

DEFECT CLAIMS
If there is a defect in the purchased item, the statutory provisions apply.

If a subsequent cure of the defect is made by means of replacement delivery, the Customer is obliged to immediately return the delivered goods to www.nimowithlove.com at the expense of www.nimowithlove.com and before delivery of the replacement goods. The defective goods must be returned in accordance with the provisions of sect. 439, para. 4, and sects. 346 to 348 German Civil Code (BGB).


APPLICABLE LAW / VALIDITY
German law applies to this relationship, excluding the application of UN sales law.
If one or more conditions are or become ineffective, this shall not affect the validity of the remaining provisions.


WARRANTY
Statutory warranty law applies.


IMPORTANT NOTICES

Presentation
The goods offered on www.nimowithlove.com are represented on the website in a clear manner and correspond substantially to reality. www.nimowithlove.com is however unable to guarantee complete agreement with reality in the images and colors that the Customer sees on its screen – a circumstance that is also due to different screen settings, graphic settings and printer settings.

Availability / Prices of the goods
Please note that the products presented at www.nimowithlove.com may no longer be available or may be unavailable at the time that the Customer visits the website and the corresponding prices may have changed.
 

One-time label
All goods ordered are delivered with single use, one-time labels affixed to them. When you try on the ordered goods, be certain not to remove or damage the single-use label. We point out explicitly that we are not obliged to take back any product when the one-time label has been removed or damaged.
